Online Tijarat Ki Jaaiz Aur Najaaiz Suraten



Sawal:Zaid ki naqaab ki dukaan hai aur Hasan mobile se online naqaab bechta hai,Zaid ne Hasan ke mobile me naqaab ke photos daale aur Hasan ne apni online ki dukaan par laga liye.
Zaid ne Hasan ko ye ekhtiyar de rakha hai ki aap hamare maal ke photo laga sakte hain,Aur aap ke paas agar koi order aata hai to aap hame bataaiye ham uske order ko aap ke bataaye hue address par bhej denge.
Ab agar Hasan ne Zaid ki koi chiz jis ki qimat 200 hai uski photo apni web-site par lagaaya aur uski qimat 500 likh diya,Jab ki Hasan ne Zaid se woh chiz kharidi nahi, Samaan ka maalik Zaid hi hai.
Customer ne Hasan ko 500 de kar order kar diya……
Ab Hasan ne Zaid ko kaha ki fulaan address par samaan bhej den aur us ne Zaid ko 200 rupiye de diye aur baaqi ke 300 rupiye apne paas rakh liya,Jo baaqi ke 300 rupiye hain us ke baare me Zaid ko kuchh matlab nahi hai.Zaid ko sirf uske 200 rupiye chaahiye.Zaid aur Hasan ke darmiyan kisi qism ki baat chit nahi hui.Lekin Zaid ko ye maloom hai ki Hasan ye kaam kar raha hai.To kya Hasan is tarah se kamaayi kar sakta hai? Aur ab tak jo is tarah se kamaaya,Kya woh jaaiz hai? Rahnumaayi farmaaiye.Jazakallah!

Jawab:Sawal me jo tariqa likha hua hai us tariqe se kharidna aur bechna baatil,faasid aur gunaah hai.Wajah ye hai ki Hasan aisi chiz bech raha hai jis ka woh maalik nahi hai.jab ki jo chiz bechna ho us chiz ka bechne wale ki milkiyat me hona zaruri hai. Jaisa ki Al-badaaye was-sanaaye me hai:

شرط انعقاد البیع للبائع ان یکون مملوکا للبائع عند البیع فان لم یکن لاینعقد وان ملکہ بعد ذلک بوجہ من الوجوہ الا السلم خاصۃ وھذا بیع ما لیس عندہ ونھی رسول اللہ صلی اللہ علیہ وسلم عن بیع مالیس عند الإنسان


Aur agar Hasan kharid kar un chizo ka maalik bhi ho jaae to bhi is tarah bechna jaaiz nahi hoga kyunki jo chiz qaabil-e-inteqaal ho (yani jin chizo ko ek jagah se dusri jagah le jaana mumkin ho) aisi chizo ko kharidne ke baad us par qabza karne se pahle bechna najaaiz aur faasid hai. Hadees sharif me hai: Huzur Sallallaho alaihe wasallam ne farmaya: Jo shakhs anaaj kharide to use nahi beche jab tak us par qabza na kar le. Hazrat ibne Abbas radhi Allaho anhuma ne farmaya ki har chiz (jo qaabile inteqaal ho) uska yahi hukm hai.[Sahih Muslim,Hadees No.3915, 3838]
Dusri hadees me aur ziyadah saaf lafzo me hai ki “Jab koi chiz kharido to use us waqt tak aage nahi becho jab tak us par qabza na kar lo.” [Musnad-e-Ahmad,Musnad-e-Hakim bin Huzaam,Hadees No.14779)
Hidaaya me hai: Jo koi aisi chiz kharide jise muntaqil kiya jaa sakta ho to use bechna jaaiz nahi hai jab tak us par qabza na kar le kyunki Huzur Sallallaho alaihe wasallam ne aisi chizo ko bechne se mana farmaya hai jis par qabza nahi kiya gaya ho. [ Hidaya,Kitabul Buyu’, Bab Murabha wa tauliya]
Upar bayan ki gayi hadiso aur ibaarato se saaf ho gaya ki aaj kal online tijaarat ka jo tariqa chal raha hai ki ek aadmi samaan kharidta hai aur us par qabza se pahle hi kisi aur ke haath bech deta hai,Ye najaaiz wa faasid hai.Aur is tarah se haasil kiya gaya maal sahih nahi hai jis ka hukm hai ki begair niyat ke sadqa kar de.
Haan! Iski jaaiz surat ye ho sakti hai ki Hasan samaan ka order le kar apne paas manga le phir kharidne wale tak pahuchaaye to “Ta’aati” ke taur par ye sahih hoga.
Aur jaaiz ki dusari surat ye ban sakti hai ki Hasan zaid ki taraf se wakil ban jaae aur uske liye woh chiz beche jab ki apne liye commission ya ujrat ka agreement kar le to ye surat bhi jaaiz hogi.
