Sawal: Kin mardon se nikah karna haraam hai ?
Jawab: Baap,Dada, beta,pota, nawasa, bhatija, bhanja, chacha, chahe nasbi ho ya radhayi yani doodh ke rishte se, in sab mardon se nikah karna haraam hai.Isi tarah woh tamaam mard jin ke nikah me uski phuphi, bhatiji, khala aur bhanji ho us se bhi nikah karna haraam hai.
Sawal: Aurat apne bahnoyi se nikah kar sakti hai ya nahi ?
Jawab: Bahan ke nikah me rahte hue bahnoyi se nikah karna haraam hai.Aur agar bahan ka inteqal ho jaaye ya bahnoyi usko talaq de de to uske baad bahnoyi se nikah kar sakti hai.
Sawal: Shadi se pahle hone wale shauhar se baat cheet karna ya usko munh dikhana kaisa hai ?
Jawab: Shadi se pahle shauhar ko chehra aur haath dikhane ki ijazat hai lekin aaj kal jis tarah se kuchh log mulaqaat karte hain aur ghanto baith kar baat cheet karte hai, iske elawah pahle hi se mobile waghaira par guftugu karne lagte hain ye sab sakht najaiz o gunah hai.
Sawal: Kya aurat ki ijazat ke bagair nikah ho sakta hai ?
Jawab: Aurat ki ijazat ke begair nikah nahi ho sakta . Hazrat Ayesha Radhi Allaho anha bayan karti hain ki : Main ne Rasoolallah ﷺ se puchha ke jab ghar wale ladki ka nikah kare to us se ijazat leni chahiye ya nahi ? Rasoolallah ﷺ ne farmaya Haan! leni chaiye, Hazrat Ayesha kehti hain ke : Maine kaha ke : Ya Rasoolallah ﷺ! Usko to sharm aayegi.To Rasoolallah ﷺ ne frmaya ke uska khamosh ho jana hi uski ijazat hai aur Tirmizi sharif ki riwayat me hai ke agar woh inkar kar de to uspar zabardasti karna Jaaiz nahi. Sawal: Kya aurat apna nikah khud karne ka haq rakhti hai ?
Jawab: Haan baliga auraton ko apna nikah khud apni marzi se karne ka ikhtiyar hai. Allah ta’ala ne Quran e majid me irshad farmaya ki :
Auraten apne baare me jo shariyat ke muatabiq kare usme koi gunah nahi hai.(Surah Baqrah Ayat No.240)aur huzur akram ﷺ ne farmaya ki : Gair shadi shuda ladki (Kanwari ho ya Bewa) Wali ki ba-nisbat apne nikah ki ziyada haqdaar hai(Sahih Muslim Hadis No.1421)aur ek hadees me jo Huzur ﷺ ne farmaya hai ke : Wali ke ba-gair nikah nahi hota “ to use muraad na-baligah aurat ka nikah hai.
Sawal: Na-baligah Auraton ka nikah karne ka ekhtiyaar kisko hai ? aur kya baligh hone ke baad us nikah ko qubul karna zaroori hai ?
Jawab: Baap, dada,bhai waghaira ko na-baligha bacchi ka nikah karne ka ekhtiyaar hai. Lekin bachchi ko khiyaar-e-balug haasil hoga, yani balig hone ke baad woh chaahe to us nikah ko rad kar sakti hai.
Sawal: Kya begair gawah ke aurat tanhaai me ya court me kisi mard se shadi kar sakti hai ?
Jawab: Nikah ke sahi hone ke liye 2 muslaman gawaho ka hona zaroori hai, isliye agar kisi aurat ne bagair gawah ke court me ho ya duniya ke kisi kone me shadi kar li to woh shadi nahi hogi. Huzur ﷺ ne farmaya ki: Badkaar hain woh auraten jo begair gawah ke apni shadi kare ( Tirmizi hadis No.1103)
Sawal: Jis aurat ka shauhar lapata ho, na kabhi koi apne baare me khabar deta ho, na uske baare me ye maloom ho ki woh ab zinda bhi hai ya nahi? To kya aisi surat me dusri shadi kar sakti hai ?
Jawab: Aisi surat me Qazi e islaam ke paas darkhwast de aur agar qazi na ho to apne shaher ke bade aalim ke paas, uske baad qazi 4 saal tak tehqeeq karta rahega agar maloom ho gaya to thik, nahi to ab qazi ki ijazat se iddat guzarne ke baad dusra nikah kar sakti hai. Ye 4 saal us din se jora jaayega jis din qazi ke yahan darkhwast di us se pehle 20 saal bhi intezaar kar chuki hai to uska koi aitebaar nahi.
Sawal: Kya koi ek mukarrar waqt tak ke liye, jaise 2 mahine ya ek do saal ke liye nikah kar sakti hai ?
Jawab: Shari’at me is tarah ke nikah ko “Mut’ah” kehte hain. aur is tarah nikah karna , naja’iz o haraam hai.( Bukhari hadis No. 5115, Muslim hadis No. 1406)
Sawal: Mahar ki adayigi se pehle aurat ko apna aap shauhar se rokne ka haq haasil hai ya nahi ?
Jawab: Mahar ki 2 qismen hain ek mahar “mu’ajjal” yani jiska ada karna fauran zaroori hai aur dusra mahar e “moajjal” yani jiski adayegi ke liye koi waqt mukarrar kiya gaya ho. To agar nikah me mahar e mu’ajjal tay howa ke fauran ada karna hoga, to jab tak aurat apna mahar wasool na kar le usko haq haasil hai ke shauhar ko apne upar qudrat na de aur agar mahar e moajjal tay howa hai maslan 2 saal ya 4 saal waghaira to us waqt ke aane se pehle shauhar ko rokne ka haq nahi rakhti.aur agar kuchh bhi tay na howa to phir wahan kaa jo aam muhaul hai usi ka aitebaar hoga. Yaani agar wahan fauran dene ka riwaaj hai to wasool kiye bagair rok sakti hai aur agar wahan ka mahaul ho ke aisi surat me maut ya talaq ke waqt hi mahar diya jaata ho to phir usko us se pehle rokne ka haq nahi.aur aksar jaghon ka riwaaj yahi hai.
Sawal: Shauhar se talaq mangna kaisa hai?
Jawab:Agar kisi sahi wajah ki buniyaad par mangti hai jaise mard jim’aa par qudrat nahi rakhta ya sharab ka sakht aadi hai waghairah to koi harj nahi aur bila kisi sahi wajah ke sirf duniya ke chakkar me phans ke maangti hai to aisi aurat sakht gunahagaar hai.Huzur ﷺne farnaya : aisi aurat par jannat ki khusbu haraam hai (Musnad e ahmad)yani woh jannat me dakhil hone ki baat to bahut door woh jannat ki khusbu bhi nahi payegi halanke jannat ki khusbu 500 saal ki musaafat tak mehsoos ki jayegi.
Sawal: Agar koi mard ham-bistari karne ki taaqat nahi rakhta, aur talaq bhi dene ko tayyar nahi to kya is surat me aurat khud talaq de kar us se juda ho sakti hai ?
Jawab: Talaq ka ekhtiyaar sirf mard ko hota hai aurat ko nahi. Allah Ta’ala ne irshad farmaya : Talaq ka ekhtiyaar sirf mard ko hai. Haan jab mard jim’aa karne par qudrat nahi rakhta hai to us par wajib hai ke woh Talaq de de, nahi to gunahagaar hoga.Allah Ta’ala irshad farmata hai : phir biwi ko bhalai ke saath rakho ya neki ke saath azaad kar do.Lekin agar shauhar nahi samajhta hai to aurat qazi aur qazi na ho to apne shaher ke bade aalim ke paas muqaddamah pesh kare phir qazi ya aalim muqaddama ki tehqiq ho jaane ke baad uske nikah ko khatam kardega.aur ab iddat guzarne ke baad aurat kahin bhi shadi kar sakti hai.
Sawal:Agar koi shakhs apni biwi ko ek saath 3 talaq de de to kya teeno (3) talaq par jayegi ya sirf 1 hi talaq hogi ?
Jawab: Teeno talaq par jaayegi. Hazrat Uwaimar radhiallaho anho ne apni biwi ko ek saath 3 talaq huzur ﷺ ke saamne hi de diya to huzur ne usko 3 talaq maana aur dono ke darmiyan judayi kar di ( Bukhari Hadees No. 5309, Muslim Hadees No.1492)Isi tarah hazrat Fatima binte qais radhi allaho anha ko unke shauhar ne ek saath 3 talaq de diya to huzur ne usko bhi 3 hi maana (Ibne Majah hadees No.2024)aur yahi huqm sahaba e kiram Ridhwanullah ta’ala alaihim ajmaeen diya karte the.isliye agar koi aurat 3 talaq ke baad apne usi shauhar ke paas rehti hai to woh sakht gunahagaar hai.
Sawal:Agar kisi ko uske shauhar ne sirf itna kaha ke “Tujhe Talaq” to iska kya hukm hai ?
Jawab:Ye talaq-e-Ra-j’ee howa. Iska hukm ye hai ki iddat ke andar agar shauhar ne hans ke baat kar liya ya chhu diya, ya usne apne baton se razamandi ka izhaar kar diya to ab nikah karne ki zaroorat nahi jaise pehle rahti thi waise hi rahe. Aur agar iddat ke andar aisa kuchh bhi nahi howa aur iddat khatm ho gayi aur ab dono ek saath rahna chaahte hain to ab phir se nikah karana padega,] nikah ke liye baraat lana, dawat ka ehtemaam karna, logo ko bulana zaroori nahi hai, do gawaho ke samne ijaab o qubul se nikah ho jata hai.
Sawal:Bagair shauhar ke talaq diye aurat dusre se nikah kar sakti hai ya nahi ?
Jawab: Nahi is tarah se nikah hoga hi nahi, aur agar aurat dusre ke saath rahti hai to woh zaaniya hai.aur jo bachche honge sab haraam honge.
Sawal:Iddat kitne din ka hota hai?
Jawab: Aurat ki haalat aur kaifiyat ke etebaar se alag alag auraton ki iddat alag alag hoti hain.agar aurat jawan hai aur shauhar ne talaq de diya to uski iddat “3 haiz” hai.aur agar hamal ki haalat me talaq de diya to uski iddat “waz-e-hamal” yani bachcha ke paida hone tak hai, aur agar shauhar ka inteqal howa aur woh hamal se hai to uski bhi iddat “waz-e-hamal” hai aur agar hamal se nahi hai to ab uski iddat 4 mahine 10 din hain. Aur agar aurat aisi umr ko pahunch gayi ke use haiz nahi aata to uski iddat 3 mahina hai.
Sawal: Iddat ke andar aurat ka ghar se nikalna kaisa hai ?
Jawab:bagair sakht zaroorat ke iddat ke andar ghar se nikalna durust nahi hai yahan tak ke haj karne bhi nahi ja sakti hai.
